企业法，是指调整企业在设立、组织形式、管理和运行过程中发生的经济关系的法律规范的总称。从法律的角度讲，企业是依法成立，具有一定的组织形式，独立从事商品生产经营、服务活动的经济组织。 企业法是以确认企业法律地位为主旨的法律体系，因此，广义企业法应当是规范各种类型企业的法律规范的总体。包括按企业资产组织形式划分的公司、合伙企业和独资企业；也包括按照所有制形式划分的国有企业、集体企业和私营企业；以及包括按照有无涉外因素划分的内资企业和外商投资企业等。目前中国现行企业法对上述不同类型的企业都有所调整。
