加班加点工资是指职工在法定节假日、公休日加班加点,或在规定的制度工作时间以外工作时发给的劳动报酬。我国统一规定的节假日是: 新年1天,春节3天,国庆节2天,国际劳动节1天。每周的休息日称为“公休日”。按国家规定,在法定节日加班的,实行计时工资的职工按本人工资的200%发给;实行计件工资的职工,除发给应得计件工资外,再按照本人标准工资100%发给。在公休日加班的,按平时标准工资计发。
工资一般不包括计时工资、计件工资、奖金、津贴、补贴和加班加点工资,以及特殊情况下支付的工资。
