债权，“债务”的对称。是指在债的关系中权利主体具备的能够要求义务主体为一定行为或不为一定行为的权利。债权和债务一起共同构成债的内容。债权与物权相对应,成为财产权的重要组成部分。与物权相比较，债权具有下列特征：（1）债权的客体可以是物，也可以是履行义务的一定行为；而物权的客体只有物。（2）债权的权利主体和义务主体都只能是特定的人；物权只是权利主体是特定的，义务主体则是不确定的。（3）债权无追及力，而物权有追及力。债权可因发生根据不同分为因合同发生的债权、因侵权行为发生的债权、因不当得利发生的债权以及因无因管理发生的债权等；因债权人的多少可分为单一债权和多数债权；因债权人之间的责任关系可分为按份债权和连带债权；因债履行选择性可分为简单债权和选择债权。
