举证责任，又称“举证的必要”。是指民事诉讼当事人对其提出的主张中须确认的事实依法负有的提出证据的义务。依现代各国民事诉讼制度，举证责任根据证明对象由双方当事人分担，适用“谁主张，谁举证”原则。但是按照实体法观点，举证责任与诉请适用的民事责任构成要件密切联系；仅特定民事责任的构成要件才属于证明对象内容。例如诉请适用违约责任的原告人不负有证明违约方过错的责任，而诉请适用一般侵权责任的原告人则负有此种举证责任。
