国民待遇亦称“国民待遇标准”。东道国对在本国境内从事社会经济活动的外国的自然人、法人提供不低于本国自然人、法人所享有的民事权利。它可以规定在本国的法律中，也可以规定在国际条约中。国民待遇分有条件的国民待遇和无条件的国民待遇两种。前者又有三种情况：一是只给在本国领土上有住所的外国自然人和有营业所的外国法人以国民待遇；二是根据国际公约给予缔约国的自然人和法人以国民待遇；三是根据对等原则，互相给予国民待遇。
