数罪并罚是指对犯两个以上罪行的犯人，就所犯各罪分别定罪量刑后，按一定原则判决宣告执行的刑罚。数罪，指一人犯几个罪。各国刑事立法规定构成数罪的时间界限有所不同：有的规定发生在判决宣告以前，有的规定在判决确定以前，还有的规定在刑罚执行完毕以前。 中国刑法规定，在判决宣告以前犯几个罪的是数罪，但判决宣告以后，刑罚尚未执行完毕以前又犯新罪的，也是数罪，应按数罪并罚的规定处罚。
