合同自由原则是指合同主体在进行合同活动时意志独立、自由和行为自主，即合同主体在从事合同活动时，以自己的真实身份来充分表达自己的意愿，根据自己的意愿来设立、变更和终止民事权利义务关系。合同是两个以上当事人意思表示的合意。合意一经完成，合同宣告成立，当事人就受到合同的拘束合同。本质上就是当事人通过自由协商，决定其相互间权利义务关系，并根据其意志调整他们相互间的关系。
诚信原则仅对合同自由原则起限制和补充作用。
