劳动能力是人进行生产活动的能力，包括体 力和脑力两个方面，是体力和脑力的总和； 是劳动者以自己的行为依法行使劳动权利和 履行劳动义务的能力，即法律上所指的劳动 行为能力。劳动行为能力丧失者意味着其不 再具有劳动的能力。在法医学实践中常需要 对工伤事故、交通事故及伤害案件中的受伤 者、患有精神障碍者进行劳动能力的评定。我国已有较为完善的各类评定标准，例如：《职工工伤与职业病致残程度鉴定》标 准、《职工非因工伤致残或因病丧失劳动能 力程度鉴定标准（试行）》、《道路交通事故 受伤人员伤残评定》标准等，其中均有关于 智力和精神伤残所致劳动能力丧失的标准。劳动能力丧失程度的鉴定是根据其完成公益 性劳动的可能性来进行评价。
