借贷合同,是指出借人把一定数量的货币或种类物交付给借用人,借用人按照约定定期或不定期地将同等数量的货币或同等数量质量的种类物归还给出借人的协议。借用人一般要向出借人支付利息。按借贷标的不同,可分为货币借贷合同和实物借贷合同。按借贷合同主体的不同,可分为公民与公民之间的借贷合同;集体经济组织与公民之间的借贷合同;国家银行等金融组织与法人、公民之间的借贷合同。
