信托关系，是指因信托合同成立，在当事人、受益人之间形成的以信托财产为基础的权利义务关系，信托关系实际上是信托法律关系。它由三个要素构成：（1）主体，指信托法律关系中权利义务的承担者，包括委托人、受托人、受益人；（2）客体，指信托法律关系主体的权利义务所共同指向的对象，即借以产生信托关系的资财；（3）内容，即信托法律关系主体所享有的权利和应当承担的义务，具体的权利义务由信托法规定。
