保安处分，是指国家基于保护社会的秩序与安全的需要，除行使刑罚权之外，对于具有社会危险性的特定的行为人，适用的医疗、禁戒、强制工作、监禁、禁止驾驶、禁止执业、监督素行、驱逐出境等具有司法处分性质的保安措施。关于保安处分与刑罚的关系，西方刑法学者之间存在着一元论与二元论的争论。（1）一元论认为，刑罚与保安处分都是实现社会防卫目的的手段，二者之间并没有什么本质的差别，因而保安处分与刑罚应当一元化，不应当作为两种性质不同的法律措施并存。（2）二元论认为，刑罚是对于已发生之犯罪的报应，而保安处分是对犯罪可能再次犯罪的预防，二者有着本质的区别，因此，保安处分与刑罚应当并存。采取保安处分制度的国家的刑法，大多都采用二元论的主张。
