任意性规范是“强行性规范”的对称。在法定范围内允许法律关系参加者自己确定相互权利义务的具体内容的法律规范。如《中华人民共和国经济合同法第9条规定：“当事人双方依法就经济合同的主要条款经过协商一致，经济合同就能成立。”任意性规范较多出现在民法、经济法等法规中。
另一种是仅在当事人选择以后双方必需遵守的任意性规范。
