劳动合同是劳动者与用人单位确立劳动关系、明确双方权利和义务的协议。在用人单位与劳动者建立劳动关系的同时,应当订立劳动合同。但现实中有很多不按时订立书面劳动合同的情况。由于一些用人单位与劳动者法律意识薄弱,或者一些用人单位利用其优势地位,违反法律规定,故意拖延或者拒绝与劳动者签订书面劳动合同,逃避应当履行的劳动合同义务,任意解除劳动关系,极大的损害了劳动者的合法权益。因此,对于这种情况,本法做出了相应的规定。
