法律术语，自愿原则是中国民法的基本原则之一，它是指公民、法人等任何民事主体在市场交易和民事活动中都必须遵守自愿协商的原则，都有权按照自己的真实意愿独立自主地选择、决定交易对象和交易条件，建立和变更民事法律关系，并同时尊重对方的意愿和社会公共利益，不能将自己的意志强加给对方或任何第三方。只要进行交易或其他民事活动双方的交易等行为不违反法律规定，其他任何机关、团体、个人等第三方都不能干涉。以欺诈、强迫、威胁等违背交易主体意志的不正当竞争行为，都为法律所禁止。
