《劳动法》第九十九条规定：用人单位招用尚未解除劳动合同的劳动者，对原用人单位造成经济损失的，该用人单位应当依法承担连带赔偿责任。这也引发了劳动者再次就业应持有离职证明书、原用人单位应为劳动者出具离职证明书的社会议论和呼声。借鉴国际经验，为维护劳动力市场秩序和劳动者的权益，2007年《劳动合同法》明确了用人单位应当出具解除或者终止劳动合同证明书的法定义务，该法第五十条规定，用人单位应当在解除或者终止劳动合同时出具解除或者终止劳动合同的证明，并在十五日内为劳动者办理档案和社会保险关系转移手续。
