间接正犯，又称“间接实行犯”，“直接正犯”的对称。是指行为人以自己的犯罪意图，利用无责任能力的人或无犯罪意思的人实施犯罪行为，以达到自己的犯罪目的的人。例如：利用精神病人或未达到刑事责任年龄的儿童实施犯罪；利用不知情的人实施犯罪行为等。一些西方国家的刑法理论中，间接正犯按正犯处罚，而被利用者则无罪。
