遵循先例是判例法的一个基本原则，它是判例法得以形成的基础。遵循先例原则的基本含义就是，包含在以前判决中的法律原则对以后同类案件有约束力，具体说就是高级法院的判决对下级法院处理同类案件有约束力，同一法院的判决对其以后的同类案件的判决具有约束力。即指以前判决中的法律原则对以后同类案件具有约束力。
遵循先例(Stare decisis)是指在普通法中,作为判例的先例对其后的案件具有法律约束力,法院以后面对相同的问题时必须作出同样判决的原则。
