违法行为又称“无效行为”。不合法行为的一种。违背法律规定的行为。与客观上不合法行为不同之处在于，行为人在实施该行为时主观上有过错，从而使法律所保护的社会关系受到侵犯。主观上的过错指故意或过失两种主观状态。根据违法性质，违法行为可分为刑事违法行为、民事违法行为、经济违法行为、行政违法行为等；根据对社会的违害程度，违法行为可分为一般违法行为和严重违法行为（犯罪）。
