过错推定是过错原则适用的一种特殊情况，是指受害人若能证明其受损害是由行为人所造成的，而行为人不能证明自己对造成损害没有过错，则法律就推定其有过错并就此损害承担侵权责任。 过错推定是在众多的工业事故造成受害人损害而又不能通过过错推定责任原则得以补救的情况下而产生的，是介于过错责任和无过错责任之间的一种中间责任形式。过错推定较之一般的过错责任，更有利于保护受害人的利益，因为它将过错的举证责任转移给了行为人，从而减轻了受害人的举证责任。
