过于自信的过失，又叫“有认识的过失”。是指行为人已经预见自己的行为可能发生危害社会的结果，但轻信能够避免以致发生这种结果的心理态度。过于自信的过失的特征表现为认识特征和意志特征，认识特征表现为行为人已经预见到自己的行为可能发生危害社会的结果，同时又轻信能够避免危害结果的发生。意志特征表现为行为人既不希望也不放任危害结果的发生，即危害结果的发生是违背行为人的意志的。行为人往往会根据自己的认识，采取一定的阻止危害结果发生的措施。
