行纪人是行纪关系中根据委托人要求代为从事购销、寄售等行纪业务的当事人。依现时大陆法国家的司法实践，行纪业务为商业活动，行纪人须履行商业登记程序取得行纪经营资格。行纪业务范围一般包括财产买卖、有价证券买卖、代为保险、代为出版、代收债权、代为担保、代登广告等。行纪人的基本义务是：以自己的名义为委托人进行交易；遵照委托人规定的条件处分财产；妥善保管待出售或已购入的财产；为委托人的利益从事其他行纪活动。其主要权利有：报酬费用给付请求权、拍卖提存权、介入权等。
