行政法治是行政法的基本原则。法律规定行政活动的机关、权限、手段、方式和违法的后果，行政活动必须遵守法律。包括三层涵义：（1）行政行为必须依据法律。行政机关不能自由采取行动，只能在法律授权的范围内活动，权限以外的行为是无效的行为；（2）行政行为必须符合法律。法律规定行政活动的目的、程序和条件，行政活动必须受法律的拘束，符合法律的规定；（3）行政机关必须采取行动保证法律规范的实施。行政机关不仅有消极的义务遵守法律，而且有积极的义务采取行动，保证法律规范的实施。
