经营者是指从事商品经营或者营利性服务的法人、其他经济组织和个人。经营者是向消费者提供其生产、销售的商品或者提供服务的公民、法人或者其它经济组织，它是以营利为目的从事生产经营活动并与消费者相对应的另一方当事人。中华人民共和国反垄断法第十二条：经营者，是指从事商品生产、经营或者提供服务的自然人、法人和其他组织。
