组织犯在刑法理论上，指在集团犯罪中起组织领导作用，或在聚众犯罪中起组织、策划、指挥作用的犯罪分子。中国刑法中没有组织犯罪规定，称之为首要分子。在我国刑法理论上,学者们由于对组织犯立法规定的理解不同,对于组织犯的概念的认识也就不尽相同。通行的观点将组织犯定义为组织、领导犯罪集团或者在犯罪集团中起策划、指挥作用的犯罪分子。
