目的犯是法律规定以行为人主观上具有一定的犯罪目的作为犯罪构成必要要件的犯罪。目的犯的目的，根据其内容可分为：（1）对行为的目的。即为实施某种行为而实施犯罪。（2）对结果的目的。即为追求发生某种危害结果而实施犯罪。对目的犯的处罚，不以行为人实施了其所追求的行为或实际上发生了其所追求的危害结果为必要，是处罚其具有特别目的的危险性。
