渎职罪是指国家机关工作人员利用职务上的便利或者徇私舞弊、滥用职权、玩忽职守，妨害国家机关的正常活动，损害公众对国家机关工作人员职务活动客观公正性的信赖，致使国家与人民利益遭受重大损失的行为。刑法规定渎职罪是为了保护国家机关的正常活动以及公众对国家机关工作人员职务活动客观公正性的信赖。 2013年1月初，《最高人民法院、最高人民检察院关于办理渎职刑事案件适用法律若干问题的解释（一）》发布，释放出从严惩处渎职犯罪的信号，致死1人以上应定罪 。
