法律规则是规定法律上的权利、义务、责任的准则、标准，或是赋予某种事实状态以法律意义的指示、规定。法律规则是构成法律的主要元素。法律规则的上位概念是法律规范（法律规范可以分为法律规则和法律原则）。中国法学对法律规范和法律规则一般不作区分，可以通用，在中国法学中，法律规范通常有两种用法，一是广义的法律规范，指称法律，它包括法律原则，法律概念，法律技术性规定和法律规范四个要素。一是狭义上的法律规范，指称法律上具有严密逻辑结构的行为规则，因此它排除了非规范性法律要素。
