法律手续，是指在不同情况下成就法律行为须做出、说出的特定行为、言词、程序步骤或应具备的各种文件的统称。是法律行为的有效条件。各种法律制度下都要求一定的法律手续，尤其在不成熟的法律制度中适用得更为普遍和严格。经常通过一定的礼节及庄重的仪式表现出来，以表明生效的法律行为的公开性，并能被人记住。如罗马法中，婚姻、认领、解放奴隶以及遗嘱等，都规定有一定的正式的形式，才能生效。某些种类的合同必须通过该要式口头合同正式的问答仪式作出。
