按份共有，是指共有人分别按照确定的份额对共有财产分享权利、分担义务。如:甲、乙、丙三个农民各出1万元买了一辆农用运输车,则甲、乙、丙对这辆车各自享有1/3的权利,也各自分担1/3的义务。按份共有各共有人的份额多少由法律规定，没有法律规定的，由共有人协议约定,原则上按各共有人的出资比例确定其共有份额。 根据我国《民法通则》第78条第二款的规定，“按份共有人按各自的份额，对共有财产分享权利，分担义务”。
