指定管辖，是指上级人民法院以裁定方式，指定下级人民法院对某一案件行使管辖权。指定管辖的实质，是法律赋予上级人民法院在特殊情况下有权变更和确定案件管辖法院，以适应审判实践的需要，保证案件及时正确地裁判。
第二十一条对管辖发生争议的，报请共同的上一级行政机关指定管辖。
