打击错误又称“目标错误”、“行为误差”行为人意图侵害某一对象，因未能控制行为方向而侵害了另一对象的错误。刑法中事实错误的一种。如行为人欲杀死某甲，于是朝某甲开枪射击，却命中某甲身边的某乙，这就是打击错误。 主要特征是：（1）行为人具有明确的侵害对象，并针对侵害对象实施加害行为。（2）实际侵害了行为人意图以外的另一个对象。（3）行为人主观上设想的因果方向与实际发生的因果方向不一致。打击错误造成侵害结果，行为人有过失的，承担过失的责任。不具有过失的，不负刑事责任。行为人的行为因打击错误而未遂，仍应负犯罪未遂的刑事责任。如果由于打击错误，行为人的行为同时触犯两个罪名的，应从一重罪处断。在中国，有的刑法学者认为，打击错误与行为人主观认识错误无关，纯属客观方面的失误，因此，不属于刑法错误的范围。
