所有权的转移 是指义务人将标的物的所有权转让于权利人的行为，通常有两种方法。 动产一般以占有为权利公示方法，除法律另有规定或者当事人另有约定以外，其所有权依交付而转移，毋须办理特殊手续。民法通则第72条第2款规定：“按照合同或者其他合法方式取得财产的，财产所有权从财产交付时起转移，当事人另有约定的除外”
