居间人，又称“经纪人”。是指居间合同中为委托人提供订约机会或充当订约媒介的当事人。居间人在委托人与第三人订立的合同中既非当事人，亦非任何一方的代理人。根据现代各国法律，居间虽为商业活动，但任何人均可自由地从事该营业，仅交易所法上的居间不在此例。居间人的主要义务是为委托人与第三人订立合同提供介绍；其主要权利是在居间成功时取得约定报酬。
