居民纳税人是指按照各相关国家法律，依据住所、居所、总机构、注册地、实际管理中心或其他类似标准确定的，在各该国负有无限纳税责任的纳税人。居民纳税人分为自然人和法人。自然人构成居民的，通常以住所或居所为标准来判定。它可以是法定住所或永久性住所，也可以是临时性居所或居住达到一定时间为限。居民自然人要承担其所在国的无限纳税责任。
一个自然人或法人，如果与征税国存在上述税收居所联系，就是该国税法上的居民纳税人（Resident Taxpayer），或称税收上的居民，而这个征税国也相应地被称作该纳税人的居住国。
