土地补偿费是国家建设需要征用农民集体所有的土地时，用地单位依法向被征地单位支付的款项。其实质是国家对农民集体在被征用的土地上长期投工、投资的补偿。其标准为：征用耕地的补偿费标准为该耕地被征前之年均产值的三至六倍，征用其他土地的补偿费标准，由各地方参照耕地的补偿费标准规定，一般为该地被征前三年平均亩产值的三至五倍。土地补偿费属于专用款项，依法应由被征地单位统一掌握，主要用于发展生产，不得挪作他用。
我国农地征用中有关土地补偿费的现实矛盾十分突出。
