合同担保，是指法律规定或者当事人约定的确保债务人履行债务，保障债权人的债权得以实现的法律措施。合同担保对于提高合同的法律效力，维护当事人的合法权益是十分必要的。为此，我国在《民法通则》、2007年3 月16 日第十届全国人民代表如保证、抵押、留置、质押等。两者都旨在保障债务的履行和债权的实现。
