法官的内心确信，是指法官在诉讼中，通过听取当事人的举证、质证、辩论、审阅卷宗、查找法律规范依据等活动，并运用既有的法律知识，按照一定的诉讼规则，对争议标的的证据采信、法律适用、裁判调整等问题，在内心形成某种确定且坚信的结论性意见，产生成竹在胸的感觉。
内心确信 （ Inner conviction ）也叫自由心证，是指对证据的取舍及证明力的大小法律不预先加以机械的规定，而是由法官根据自己的良心、感悟等自由判断。
