典卖，又称“活卖”。是指中国历史上买卖不动产的一种方式。指将房屋、田地等不动产出典于人，收取一定典价，在约定期限内原价回赎。与绝卖不同：绝卖是所有权的转移，不能赎回，而典卖则是附条件的、临时的所有权的转让，可在一定期限内赎回原物，过期不赎才视为绝卖。始见于《唐明律合编》转引“元律”：“诸典卖田宅，从有司给据立契。”明清律均规定：不税契者，不过割者，重复典卖者，均应依法治罪。
