共同保证是数人就同一债务人的同一债务共同担保的保证。为保证的种类之一。共同保证的共同保证人与债权人之间约定按份承担保证责任的，应按约定的份额承担保证债务，即各保证人仅就自己的份额负保证责任。如果法律没有另外规定当事人又未约定或约定不明确的，则视为各保证人负连带保证责任。债权人对于共同承担连带保证责任的保证人中的一人或数人有履行全部保证债务的请求权，各保证人均有履行全部保证债务的义务。
