先决问题（preliminary question），亦称附带问题（incidental problem），是涉外民事关系法律中的概念，先决问题与主要问题（principal question）相对应，是指处理涉外民商事案件（即主要问题）所必须首先要加以解决的其他问题。先决问题最早由德国学者梅尔基奥（Melchior）和威廉·温格勒（Wilhelm Wengler）在1932年至1934年提出。
