债务人，与“债权人”相对，根据《中华人民共和国合同法》 的相关规定，债务人是债权关系中有义务按约定的条件向另一方（债权人）承担为或不为一定行为的当事人。是指根据法律或合同、契约的规定，在借债关系中对债权人负有偿还义务的人。与"债权人"(creditor)相对。在财务会计学的术语中， 债务人是指欠别人钱的实体或个人。 债务人负有展行其合同债务的义务，包括单独债务人、连带债务人、不可分债务人、保证债务人。但债务人展行时是否要求具有行为能力,依履行行为性质决定。展行行为是事实行为时，不要求债务人有行为能力;是法律行为时,则必应具有行为能力。除此以外，如果债务的履行需要债务人通过移转财产权利来进行，则债务人应享有对该财产的处分权。另外，债务人可以使用履行辅助人行债务。在给付为法律行为时，可委托代理人作出。因此，履行债务人和债务人的代理人也可纳入债务人的范畴。
