保证期间，是指当事人约定的或者法律规定的，保证人承担保证责任的期限。保证人与债权人约定保证期间，按照约定执行。保证人和债权人未约定保证期间的，法律规定保证期间为6个月。保证期间均自主债务履行期届满之日起计算。一般保证的债权人在保证期间内未对债务人提起诉讼或者申请仲裁的，保证人免除保证责任; 连带责任保证的债权人在保证期间内没要求保证人承担保证责任的，保证人免除保证责任。
