从一重处断是指按照犯罪行为所触犯的数罪中处罚最重的犯罪来定罪处罚。由于现行牵连犯的概念过于宽泛,既包括数罪的情形也包括一罪的情形,因而无论对牵连犯采数罪并罚还是一罪处断的处罚方针,都是不科学的。
该罪与其他秘密犯罪是想像竞合关系，应从一重处断；
