主合同：不以他种合同的存在为前提，不受其制约而能独立存在的合同。（借贷合同） 根据合同相互间的主从关系，可以将合同分为主合同与从合同。所谓主合同，是指不需要其他合同的存在即可独立存在的合同。例如，对于保证合同而言，设立主债务的合同就是主合同。
