中立法，是指规定交战国与中立国之间权利和义务关系的原则、规则和制度。中立法的形成基于以下两个基本事实：(1)中立国希望得到保证，使自己尽可能少地由于战争而受到损害; (2)交战国希望得到保证，中立国不仅在形式上，而且在实质上保持中立，不向对方提供任何援助。不参与和对各方平等待遇是中立法的两块基石。
