“两造” 这个古汉语词汇出自《书经·吕刑》中的“两造具备，师听五辞”。按照《周礼·司寇》的记载：“以两造禁民讼，入束矢于朝，然后听之”。就是说原告和被告双方都到“法庭”上来，都交纳一束代表“正直”的箭，然后“法官”才开始审理。如果有一方不来、或者不交箭，就说明他理亏不直，自认败诉。后来人们就把“两造”专指有关争讼的双方当事人。
