不能犯未遂是“能犯未遂”的对称。简称“不能犯”。行为人已经着手实行犯罪，由于行为人事实认识错误而不可能达到犯罪既遂状态的一种犯罪未遂。刑法理论上以犯罪行为实际上能否构成既遂为标准所划分的犯罪未遂类型。主要特征是：(1) 行为人已经着手实行犯罪。（2)犯罪行为在实际上不能达到犯罪的既遂状态。（3)犯罪行为在实际上不可能达到犯罪既遂状态的原因，在于行为人的事实认识错误。不能犯未遂可以划分为：工具不能犯与对象不能犯，绝对不能犯与相对不能犯，法律不能犯与事实不能犯等类型。
