不当得利，是指没有合法依据，有损于他人而取得利益。不当得利的法律事实发生以后，就在不当得利人与利益所有人（受害人）之间产生了一种权利义务关系，即利益所有人有权请求不当得利人返还不应得的利益，不当得利者有义务返还。这也就在双方之间产生一种债的关系。 在此行为之中，取得利益的人称受益人，遭受损害的人称受害人。受益人与受害人之间因此形成债的关系，受益人为债务人，受害人为债权人。
