三法司是中国古代三个中央司法机关的合称。《商君书·定分》：“天子置三法官，殿中置一法官，御史置一法官及吏，丞相置一法官。”后世“三法司”之称即源于此。汉代以廷尉、御史中丞和司隶校尉三个司法机关的会议，称三法司。《新唐书·百官志一》：“凡鞫大狱，以尚书侍郎（指刑部）与御史中丞、大理卿为三司使。”重大案件皆由三个机关共同审理，明清两代以刑部、都察院、大理寺为三法司，遇有重大案件，由三法司会审，也称“三司会审。”
