Paul Staddon, representing Mr Mendoza, argued that to give a statutorytenancy to the survivor of a heterosexual relationship when the survivor of an equivalent homosexual relationship was limited to the less beneficial assured tenancy, constituted discrimination on grounds of sexual orientation.
